Using samples from the U.S. and Puerto Rico, we examine cross-cultural differences in cultural value dimensions, and relate these to act and rule utilitarian orientations, and ethical decision making of business professionals. Although these places share the same legal environment, culturally they are distinct. In addition to tests of between-group differences, a model in which utilitarian orientation mediates the influence of cultural values on ethical decisions was evaluated at the individual level of analysis. Results indicated national culture differences on three (...) cultural values, but no between-group differences on utilitarian orientations and ethical decisions. Significant indirect effects were found; act utilitarian orientation mediated the effects of two values activity orientation and universalism on ethical decision making. Communicating at the end-of-life (EOL) requires deep sensitivity and adherence to strong ethical principles that respect the dignity, rights, and values of patients and their families. However, many nurses find this task emotionally challenging, especially in settings with limited training and strong cultural taboos about death. In Ghana, little is known about how nurses experience and manage these conversations in everyday clinical practice. This study explored nurses’ experiences communicating with families at the end of life. This study adopted an interpretivist (...) qualitative design to explore the experiences of nurses at a district hospital in the Volta Region of Ghana. The Consolidated Criteria for Reporting Qualitative Research (COREQ) guided the study. Twenty registered nurses with at least two years of clinical experience participated in in-depth, semi-structured interviews. Data were analysed inductively using Braun and Clarke’s reflexive thematic analysis approach. The research team engaged in continuous reflexive practice to ensure analytic rigor. Three major themes were identified: (1) emotional and psychological challenges of breaking bad news, (2) coping mechanisms and professional obligations, and (3) institutional and cultural barriers to effective communication. Nurses described sadness, fear, and hesitation when informing families about death or poor prognosis, but they still viewed it as a core professional duty. Coping strategies included information gathering, teamwork, and personal faith. Communication was largely informal, with limited guidance or training. Cultural beliefs about death, family blame, and lack of privacy or institutional support further complicated interactions. Strengthening training, developing institutional guidelines, and incorporating cultural understanding into communication practices could help nurses deliver end-of-life care with greater confidence and support. Communication during the end of life must be done correctly to convey the correct meaning of the message to the client and family. The findings will enable other nurses to identify with the experiences shared in this article and how to cope in such situations. (shrink)

In political culture, Hong Kong has undergone dramatic changes in recent decades. When Hong Kong was a British colony, its people were largely concerned to maintain the status quo so that they could be left alone; the ideal government was perceived as a paternalistic one which would maintain law and order. With their increasing involvement in political parties and pressure groups, more Hong Kong people are prepared to fight for their rights and demand “freedom and democracy”; they want a more (...) representative government in the form of a widely elected Legislative Council. The return to Chinese sovereignty in 1997 and “one country, two systems” means that the Hong Kong people have to learn to administer their own affairs. Yet this is within a context in which China is suspicious of a democratic regime in Hong Kong on the grounds that it threatens her rule over the territory. This paper considers the implications of this situation for civic education in Hong Kong, which was promoted in schools after the publication of the Guidelines in 1985. With July 1997 looming, it is timely to review the programme's objectives, achievements and prospects. (shrink)

British historians drew on anthropological exemplars to remake social history between 1959 and 1977. Eric Hobsbawm's ‘primitive rebels’, Peter Laslett's World We Have Lost, Keith Thomas’s studies of witchcraft, and E. P. Thompson's ‘moral economy’ were all inspired by contemporary social anthropology, and they transformed historians’ understanding of the past. Reconstructing this moment of cross-disciplinary research contributes to our understanding of broader changes in the mid-century human sciences. This was a moment of grand theorizing about ‘modernization’, capitalism, and industrialization. Social (...) historians responded to these concerns by drawing analogies between the past and the ethnographic present. Driving is central to adult independence and autonomy; yet most autistic young adults do not acquire driver’s licenses. It is important to understand barriers to achieving this milestone for autistic adults. Differences in negative affect and emotion dysregulation associated with autism may interfere with managing difficult driving situations. The current study compared perceived driving difficulty, emotion dysregulation, and negative affect in emerging drivers with and without autistic traits, and investigated how emotion dysregulation and negative affect relate to perceived DD. We (...) expected greater perceived DD, emotion dysregulation, and negative affect in participants with AT and a positive correlation of perceived DD with both emotion dysregulation and negative affect in the whole sample. Thirty-seven adolescents and young adults self-reported perceived DD in 15 scenarios and completed the Difficulty in Emotion Dysregulation Scale and the Depression, Anxiety, and Stress Scale. Autistic participants scored significantly higher on mean perceived DD, DERS Impulse subscale, DASS total and DASS Stress subscale scores. Perceived DD positively correlated with the DERS and DASS total scores, all DASS subscales, and DERS Nonacceptance, Goals, and Impulse subscales across the whole sample. The findings highlight the roles of emotion dysregulation and negative affect in perceived DD in emerging drivers with AT. In particular, emotional stress and impulsivity may map onto mechanisms of over-reactivity to negative affect and explain why autistic people perceive particular situations as difficult when driving. Paired associative stimulation at the spinal cord has been shown to increase muscle force and dexterity by strengthening the corticomuscular connection, through spike timing dependent plasticity. Typically, transcranial magnetic stimulation and transcutaneous peripheral nerve electrical stimulation are often used in spinal PAS. PNS targets superficial nerve branches, by which the number of applicable muscles is limited. Alternatively, a muscle can be activated by positioning the stimulation electrode on the “motor point”, which is the most sensitive location of a muscle to (...) electrical stimulation. Although this can increase the number of applicable muscles for spinal PAS, nobody has tested whether MPS can be used for the spinal PAS to date. Here we investigated the feasibility of using MPS instead of PNS for spinal PAS. Ten healthy male individuals received spinal PAS on two separate days with different stimulation timings expected to induce facilitation of corticospinal excitability or no effect on the soleus. The motor evoked potentials response curve in the soleus was measured prior to the spinal PAS, immediately after and at 10, 20, 30 min post-intervention as a measure of corticospinal excitability. The post-intervention MEP response curve areas were larger in the REAL condition than the CONTROL conditions. Further, the post-intervention MEP response curve areas were significantly larger than pre-intervention in the REAL condition but not in the CONTROL condition. In recent years, there has been a wide-ranging debate about the neo-republican principle of non-domination. Neo-republicans argue that domination is a capacity for one to intentionally use arbitrary power to interfere in someone’s life. Critics of neo-republicanism argue that this definition of freedom as non-domination precludes a structural analysis of domination, which would explain and critique the ways in which societies produce structural domination unintentionally. The article focuses on capitalism’s labor process and its labor markets. It argues that critics are (...) correct to think that the neo-republican principle of non-domination has an insufficient scope, but that an alternative account of structural domination should still support the neo-republican idea that agency must be involved. Otherwise, we might simply fail to explain the social processes that reproduce structural domination. What is needed is to explain how the labor process creates incentives for agents to intentionally produce structures that have unintended, yet dominating effects, and in turn, how the intentions of agents are conditioned by their social positions. This article explores an under-examined theme, which is who or what is the working class and what is wrong with the situation that members of this class share. It argues that class divisions impose a unique harm for a diverse and interdependent group within capitalist societies both in spite and because of differences among group members. Class matters not just because it creates economic groups in which some are rich and others are poor, but because competition creates conditions that militate (...) against solidarity, toward cleavage and conflict. Systematic ethics support in community health services in Norway is in the initial phase. There are few evaluation studies about the significance of ethics reflection on care. The aim of this study was to evaluate systematic ethics reflection in groups in community health , - from the perspectives of employees participating in the groups, the group facilitators and the service managers. The reflection groups were implemented as part of a research and development project.

Ethics support in primary health care has been sparser than in hospitals, the need for ethics support is probably no less. We have, however, limited knowledge about how to develop ethics support that responds to primary health-care workers’ needs. In this article, we present a survey with a mixture of closed- and open-ended questions concerning: How frequent and how distressed various types of ethical challenges make the primary health-care workers feel, how important they think it is to deal with these (...) challenges better and what kind of ethics support they want. Five primary health-care institutions participated. Ethical challenges seem to be prominent and common. Most frequently, the participants experienced ethical challenges related to scarce resources and lack of knowledge and skills. Furthermore, ethical challenges related to communication and decision making were common. The participants welcomed ethics support responding to their challenges and being integrated in their daily practices. (shrink)

The relationship between traumatic experiences and subsequent distress is not well understood, and little research focuses on the lived experience of psychological trauma. I draw on Louis Sass’s phenomenological taxonomy to address this lacuna. I present his differentiation between relations of phenomenological causality and implication and demonstrate that his taxonomy can be applied to experiences of trauma. Relations of phenomenological causality and implication can be identified in the genesis and constitution of post-traumatic distress. My adaptation of Sass’s taxonomy will furthermore (...) offer an extension and development of his account, applying it to the study of post-traumatic experiences and elaborating it in the process. I shall demonstrate that whether experiences occur synchronically or diachronically is not essential to their categorization in terms of phenomenological implication and causality, respectively. I will show that an alteration in perception or behavior post trauma might temporally succeed the traumatizing event while, at the same time, being implied in the experience of the event. Thereby, I demonstrate how phenomenology may contribute to a detailed understanding of experiences of trauma. Scrutiny of traumatic experiences furthermore promises to contribute to the philosophical discourse on causality, implication, and temporal experience. (shrink)

In this article, I will outline an assessment model that allows instructors to continuing assigning term papers and argumentative papers without compromising the authenticity of student assessment. This path forward relies upon a pseudo flipped classroom model in which students will complete a scaffolded term paper through a series of in-class assessments that build upon previously completed components. The final steps of completing this assignment will require producing a draft and final version of a traditional term paper outside of the (...) classroom but only after the instructor ensures they have critically thought through the preceding components independently. The intention is to maintain the nuance, critical thinking, engagement with primary and secondary sources, and depth of content comprehension that a thoughtful paper requires, while also ensuring that students are completing the work themselves and not merely outsourcing bits and pieces of it to LLMs. (shrink)

Africa has a colonial past that renders it a linguistic melting pot, where language is not only important for communication but is inextricably related to cultural identity. In Africa, there are over 2000 languages that are still being used and spoken. Language diversity coupled with cultural diversity may affect the process of obtaining informed consent in data-intensive research. We explore some of the challenges and opportunities of multilingualism in handling informed consent in the context of data-intensive research. In multilingual contexts, (...) as in most African countries, language is exceptionally central, and translation has potential cultural, social, historical, functional and scientific importance. However, it is recognised that terminological and translation activities may not always be cost-effective or feasible. We consider alternative mechanisms of harmonisation of data-related terminology and concepts in multilingual contexts, such as iconography, graphic elicitation and other multimedia formats of information sharing. The inclusion of visual or multimedia explanations in informed consent forms can improve comprehension, enhance information transfer and learning, reduce potential vulnerabilities associated with low literacy levels or the inability to interpret technical language associated with data-intensive research, build trust with participants and their communities, and promote autonomy of potential participants. We recognise that the inclusion of visual or multimedia content to facilitate information transfer is only one component of the informed consent process for data-intensive research. Research ethics committees (RECs) should be mindful of other key considerations and challenges of informed consent for data-intensive research in sub-Saharan Africa (SSA), and to explore whether these alternative forms of consent are ethical and effective in multilingual contexts. The Norwegian Parliament has decided to give priority to ethics in municipal health services. This priority is supposed to raise competence in ethics within municipal health services. As part of the national project, the participating municipalities were encouraged to develop and carry out local projects. In this article, we present a local ethics project in one of the participating municipalities in central eastern Norway. The local project for raising competence in ethics was carried out in cooperation with researchers at the (...) Centre for Medical Ethics (CME) at the University of Oslo. Most people agree that ethics are important in health services. However, there are many ways to increase competence in ethics and to stimulate ethical reflection. In this article we present a broad overview of this local ethics project, but special focus will be put on presenting the actions that have been used for increasing the level of ethical competence and stimulating ethical reflection among the participants. We describe our evaluation of the project and the research we carried out. Explanations will be given for the thought process behind the decisions that were made. (shrink)

Their nursing experience and/or training may lead students preparing for the nursing profession to have less moral distress and more favorable attitudes towards a hastened death compared with those preparing for other fields of study. To ascertain if this was true, 66 undergraduates (54 women, 9 men, 3 not stated) in southeastern USA completed measures of moral distress and attitudes towards hastening death. Unexpectedly, the results from nursing and non-nursing majors were not significantly different. All the present students reported moderate (...) moral distress and strong resistance to any efforts to hasten death but these factors were not significantly correlated. However, in the small sample of nurses in training, the results suggest that hastened death situations may not be a prime reason for moral distress. (shrink)

With my research, I wish to contribute to the discussion of post-traumatic psychopathologies from a phenomenological perspective. The main question I pursue is to what extent PTSD can be understood as an intersubjective psychopathology and which implications this view might have. In this paper, I argue that the mode of perception allowing for intersubjective experience is vulnerable to disruptions through traumatic events. I begin with a short elaboration on what intersubjectivity entails before proceeding to illustrate how it can be impaired. (...) Then, I focus on the concept of empathy as a mode of perception: I propose that due to a disruption of the ability to empathize an individual suffering from PTSD may cease to experience the other as another subject that offers possibilities for interaction. The traumatized individual is thus unable to establish meaningful connections with others. I offer some implications this view might entail for thinking about trauma treatment. (shrink)

The treatment of employees during downsizing and corporate restructuring raises many ethical issues. To provide a common framework for understanding ethical decisions facing organizations delivering the news of dismissal to affected employees, Integrative Social Contracts Theory and the research on social exchange was used to integrate existing research on employee dismissal. Of particular importance was determining the criteria necessary to manage the dismissal process within ethical boundaries. Three basic criteria, which together represent a variety of contractual and transactional obligations, are (...) proposed as necessary for an ethical approach to dismissal; 1) advance warning of the job loss, 2) open communication, and 3) institutionalized support services. The frequency with which organizations meet these criteria is examined using a geographically dispersed, cross-organizational sample of 770 involuntarily displaced professional employees. In addition, the effect of such an ethical approach to dismissal on individual psychological and financial outcomes is examined. Findings are discussed as they relate to the implicit contract between employee and employer and organizations' responsibility to employees during corporate restructuring. (shrink)

Kliniske etikkomiteer har vært etablert i norske helseforetak siden 1996, først som et prøveprosjekt, senere som et permanent tiltak med et nasjonalt mandat. I forbindelse med det nasjonale etikkprosjektet «Samarbeid om etisk kompetanseheving» har det også i noen kommuner blitt etablert KEK. Senter for medisinsk etikk ved Universitetet i Oslo er tildelt ansvaret for oppfølging av KEK i helseforetakene og er i tillegg gitt et langsiktig ansvar for etikkarbeid og forskning i den kommunale helse- og omsorgstjenesten. Hensikten med denne studien (...) har vært å fremskaffe kunnskap om hvordan det står til med KEK som er etablert i kommunene. Hva jobber de med, hvilken betydning erfarer de at KEK har og hvilke ressurser har de? Studien har et kvalitativt design. Clinical ethics committees have been established in Norwegian hospital trusts since 1996, first as a pilot project, later on a permanent basis with a national mandate. As part of the national ethics project "Cooperation on ethical competence" some municipalities have also established a CEC. Centre for Medical Ethics at the University of Oslo is given the responsibility to support CECs in hospital trusts, and is also given a long-term responsibility for ethics support and research in municipal health care services. The purpose of this study was to obtain knowledge about the situation of CECs established in municipalities. What are they working on, what impact do they find that CEC has, and what resources do they have? The study has a qualitative design. The material is based on telephone interviews with CEC chairs, and reviews of the committees' annual reports. We have carried out a qualitative content analysis of the data. The committees work with individual cases, issues of a more principle character, and ethics training. The work is considered to be significant, and is carried out despite limited resources and weak anchoring. Perhaps a stronger anchoring, resource situation and a national mandate could strengthen the committees’ situation. This study ascertained reports of assent (affirmative agreement) and permission (agreement by an adult fully capable of being informed) in 114 children's research articles in 1990 in Child Development (CD), Journal of Consulting and Clinical Psychology (JCCP), Journal of Pediatric Psychology, and Journal of Clinical Child Psychology. Of the research projects, 43% failed to specify permission, and 68.5% failed to specify assent. JCCP reported assent significantly more than CD. Assent was reported significantly more in research with older children than with (...) younger children. This lack of sensitivity to assent and permission suggests that many authors, reviewers, and editors consider reporting assent and permission unessential. We recommend specifying assent and permission in all manuscripts, highlighting children's research issues in graduate training, and using specific safeguards when conducting research with children. In this paper, I enquire into the nature of the influence culture has on the experience of trauma. I begin with a brief elaboration of the dominant conceptualisation of post-traumatic experiences: the diagnostic category of PTSD as it can be found in the DSM. Then, I scrutinise the nature and extent to which cultural factors may influence the phenomenology of the experience of certain events as traumatic and subsequent symptoms of post-traumatic stress. It seems that cultural circumstances alter the way (...) in which trauma is experienced; it is not clear whether there is in fact a core pathology of PTSD, as the DSM assumes, or whether the structure of the experience of trauma is too multifaceted to be summarised in one diagnostic category. Finally, I show that phenomenological enquiry promises to identify the structural similarities that would justify the delineation of a distinct diagnostic category. (shrink)

In this paper I argue that Nancy Fraser’s theory of social reproduction is misleading and that the process of exploitation is more central to women’s oppression than Fraser’s theory suggests. I argue that Fraser’s theory of women’s oppression is continuous with her theory of capitalism and political agency. I critique Fraser’s theory of capitalism at a structural level to clarify some of the ambiguity in her position about the difference between production and reproduction. I then compare Fraser’s view with a (...) structural view of class to make my critique and extend it to her theoretical distinction between status and class. (shrink)

Climax is a compound rhetorical figure, consisting of the trope, Crementum, and the scheme, Gradatio (itself a series of Anadiploses), a combination that results in compelling semiotic effects. The component figures impact the conveyed meaning independently and collectively, which we chart by way of the PATH image schema and the Gestalt Figure-Ground relation. These layers of meaning function in a similar fashion to the dual figure visual phenomenon examined by Koffka and Rubin. Key elements of our project include knowledge representation (...) of Climax and component figures, a suite of ontologies that map the cognitive features supporting these complex structures and a base model of surface entities augmented with the related cognitive functions. Legal access to safe abortion is fundamental for enjoying the rights guaranteed in the Constitution of Kenya, including the rights to life and health. The UN Committee on Economic, Social, and Cultural Rights (CESCR) recognizes reproductive rights as an integral part of the right to health and identifies the denial of abortion as a violation of the right to life. However, the Human Rights Committee’s comment on the right to life acknowledges that states, in exercising their sovereignty, can regulate the (...) voluntary termination of pregnancy. Article 26 of the Constitution of Kenya guarantees the right to life. Sub-article 2 states that life begins at conception and outlaws abortion in sub-article 4. Nevertheless, sub-article 4 of the same article contains exceptions and permits abortion under specific conditions, such as when the life and health of the mother, which encompasses physical, psychological, mental, and emotional health, are at risk. Article 26(4) also makes provision to introduce additional circumstances for abortion through legislation. There have been progressive policy measures taken to provide access to safe reproductive health services, including efforts to ensure safe abortion in Kenya. However, attempts at legislation on reproductive rights have been problematic, particularly where provisions include abortion. The 2019 Reproductive Health Bill is the latest of several attempts to address the right to reproductive health care. The objectives of this article are to (1) examine the attempts that have been made to legalize abortion; (2) highlight efforts that have been made to address the right to abortion; and (3) discuss the morality and ethics of abortion in Kenya. Gender equality is something that the human race has been struggling with since time immemorial. No country has achieved gender equality despite the legislative, social, and economic gains for women. Therefore, modern society likes to blame certain groups, such as religion for the gender inequalities which are faced, more than others. The main focus of this study is to evaluate the role of religious leaders in promoting gender equality through the legislation and religious texts in Zimbabwe. The study further explores (...) how certain religious norms and practices can be modified through religious texts to accommodate women in achieving gender equality. The paper acknowledges that religious leaders have a greater responsibility to standup, speak and act with and on behalf of those with less power, such as the marginalized and discriminated against, including exploited planet Earth. The paper seeks to foreground how certain traditional religious practices and norms have exacerbated gender inequality in Zimbabwe, despite the laws that have been enacted by the government of Zimbabwe to promote gender equality. The data for the paper was gathered through observations and semi-structured interviews conducted with both religious leaders and women to establish how religious norms and practices directly or indirectly affect women and how they can be modified to achieve gender equality in Zimbabwe. The data gathered was analysed through descriptive data analysis. The paper concludes by recommending that religious leaders should be thoroughly trained on how to promote gender equality through religious texts and legislation. Contribution: The article evaluated the role of religious leaders in promoting gender equality through legislation and religious texts in Zimbabwe. It argued that religious leaders have a higher need to support, advocate and act on behalf of individuals who are marginalised and subjected to discrimination on planet Earth. Hence, its contribution was in promoting gender equality through religious texts and legislation in Zimbabwe for sustainable development. (shrink)

Surrogacy is a complex and sensitive subject that raises ethical and legal issues. It is a controversial subject whose implications are numerous. Legalization has been proposed as a solution, but it may not be the absolute answer. A possible way out of the intricacies is a well-coordinated system that takes cognizance of the rights of all involved parties. This chapter focuses on the ethical and legal perspectives of surrogacy. Legal and regulatory frameworks governing surrogacy have been discussed with an emphasis (...) on the ethics of surrogacy. The need for surrogacy is occasioned by infertility. Surrogacy is a solution to infertility and an adoption option. It is either altruistic or commercial, depending on the laws of different states. Emerging ethical concerns are the right to dignity, autonomy, justice, and compensation. To deal with emergent ethical issues, some countries have laws that determine the judicial process, and where laws are lacking, couples are left at the mercy of the courts. The nonexistence of laws exposes women and young girls to human rights abuse and exploitation. An internet search was conducted on PUBMED and Google Scholar databases and the research stepwise approach that embraces integration, interdisciplinarity, and transdisciplinarity. The final part of this chapter suggests solutions to the ethical complexities of surrogacy. The solutions include legalization and review of laws, development of guidelines for assisted reproductive technologies, education of interested parties, provision of fertility care, and development of health policies. In 1993, after an optimistic beginning followed by a half-decadeof conflict, the Superconducting Super Collider (SSC) project wasabandoned. In an era of `Big Science', a major scientificenterprise collapsed. Why? We employ the metaphor of the`frontier outpost' to analyse a critical moment in the history ofthis vastly expensive project, when the physicists who designedthe machine were forced to recognize that traditional post-warscientific values were no longer in harmony with governmentpriorities.

The Punishment of Dirce was a theme that intrigued both artists and patrons of the Roman period. It appeared in diverse locations and media, notably as a wall painting in the House of the Vettii in Pompeii and the Toro Farnese once displayed in the Baths of Caracalla in Rome. In all representations, Dirce struggles with the bull that will trample her to death. Traditional studies of this imagery have focused on the formal characteristics of these representations, studying issues of (...) workshop practice and the relationship between originals and copies. Scholars seldom analyze the meaning of the myth in depth. While most studies note that Dirce often appears in the guise of a maenad, they dismiss this observation. Additionally, it is rarely noted that Dirce's semi-nudity has any role in this story. In fact, her nudity is highly significant, for it was not part of the literary accounts. This study offers a fresh interpretation of Dirce's punishment considering the function of gender. Using literary sources such as Euripides, Plautus, Lucian, and Petronius, as well as visual images in a variety of media including wall painting, sculpture, gems, medals, and lamps, it is argued that artists and patrons combined maenadism and nudity to portray Dirce as a specifically female social transgressor. As a semi-nude maenad, the queen abandons accepted female decorum. These attributes allow the viewer readily to identify Dirce as guilty of hubris against family and society. (shrink)

Violence sells, Americans have what sometimes seems to be an insatiable appetite for it. Depictions and descriptions of violence saturate our culture. songs urge us to rape women, kill police officers, and commit suicide. Movies portray-indeed they glorifyviolence as an intrinsic element of every imaginable plot line.Despite substantial evidence that an individual’s repeated exposure to portrayals of violence is associated with significantly increased likelihood that the individual will commit aggressive acts against others, no legal regime currently regulates such portrayals either (...) on television, in music, in movies, or in video games. Neither Congress, the Federal Communications Commission, the Federal Trade Commission, nor any state legislature has yet mustered the political will to impose substantial or systematic legal constraints upon producers or purveyors of violent images. Official censorship is rightly to be feared, but unreflective invocations of our commitment to freedom of speech provide incomplete justification for our legal regime’s apparent indifference to the possibility that media-induced violence may impose substantial costs on innocent victims. Inclusive, non-elitist art spaces are mounted by remarkably talented, creative individuals. Alfred Stieglitz and Donald Judd were two such individuals. Stieglitz's space was an intimate urban art gallery in Manhattan while Judd's space in Marfa, Texas was expansive, isolated, and rural. Aside from sharing the usual characteristics of the very creative, both were charismatic, physically attractive, intelligent men who held forceful visions about art. Unlike most of their peers, they had the capacity to write well and speak convincingly. Their resolute (...) confidence and aesthetic competencies enabled them to attract and hold astute colleagues. While debate continues over the role of the lawyer in society, this article notes that the recently amended professional conduct rules of both barristers and solicitors and the proposed draft National Law prioritise the duty to the court and the administration of justice. In addition, the Australian Learning and Teaching Council's threshold learning outcomes for legal education corroborate these obligations when they assert that the role of a lawyer includes a professional responsibility to promote justice in service to the community. By referring to Australia's proposed regulatory framework and associated national professional conduct rules, and drawing upon the American Bar Association's Model Rules of Professional Conduct and a body of US literature that refers to lawyers as public citizens, this article will argue that Australian lawyers owe a duty to the public in their everyday dealings with clients. In doing so, this article will refer to some theories of citizenship; and what it means for lawyers, in a practical sense, to act as public citizens. (shrink)
